Toto v\u00fdznamn\u00e9 jubileum zd\u00f4raz\u0148uje jeho trval\u00fa a nenahradite\u013en\u00fa \u00falohu pri zjednocovan\u00ed dopravn\u00e9ho pr\u00e1va, zatia\u013e \u010do rast\u00faci po\u010det kraj\u00edn zav\u00e1dzaj\u00facich eCMR z\u00e1rove\u0148 poukazuje na prechod odvetvia smerom k bezpapierovej prev\u00e1dzke.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ako po\u010das osl\u00e1v 70. v\u00fdro\u010dia zd\u00f4raznila Eur\u00f3pska hospod\u00e1rska komisia OSN (UNECE), CMR sa uk\u00e1zal ako z\u00e1klad transparentnej a efekt\u00edvnej medzin\u00e1rodnej cestnej n\u00e1kladnej dopravy, ktor\u00fd zabezpe\u010duje pr\u00e1vnu istotu, spo\u013eahlivos\u0165 a jednotnos\u0165.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Aj po siedmich desa\u0165ro\u010diach zost\u00e1va CMR jedn\u00fdm z najroz\u0161\u00edrenej\u0161\u00edch medzin\u00e1rodn\u00fdch dopravn\u00fdch dohovorov, prep\u00e1jaj\u00facim v\u0161etky druhy dopravy a \u00fa\u010dastn\u00edkov odvetvia s cie\u013eom u\u013eah\u010di\u0165 fungovanie glob\u00e1lnych dod\u00e1vate\u013esk\u00fdch re\u0165azcov a ka\u017edodenn\u00fd pohyb nevyhnutn\u00e9ho tovaru \u2013 uviedla v\u00fdkonn\u00e1 tajomn\u00ed\u010dka UNECE Tatiana Molcean.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">K dne\u0161n\u00e9mu d\u0148u sa zmluvn\u00fdmi stranami dohovoru stalo celkovo 58 kraj\u00edn (vr\u00e1tane takmer v\u0161etk\u00fdch eur\u00f3pskych \u0161t\u00e1tov, v\u00fdznamn\u00e9ho po\u010dtu \u00e1zijsk\u00fdch kraj\u00edn, ako aj viacer\u00fdch \u0161t\u00e1tov severnej Afriky). Zoznam \u010dlensk\u00fdch kraj\u00edn je dostupn\u00fd na webovej str\u00e1nke UNECE spolu s textom dohody (ktor\u00fd zostal dodnes nezmenen\u00fd). M\u00f4\u017eete si tie\u017e prezrie\u0165 p\u00f4vodn\u00fd dokument z roku 1976 a zisti\u0165, kto podp\u00edsal dohovor v mene jednotliv\u00fdch kraj\u00edn pred siedmimi desa\u0165ro\u010diami, \u010do je obzvl\u00e1\u0161\u0165 zauj\u00edmav\u00e9 vzh\u013eadom na to, \u017ee politick\u00e1 mapa Eur\u00f3py dnes vyzer\u00e1 \u00faplne inak (Sovietsky zv\u00e4z, Juhosl\u00e1via ani \u010ceskoslovensko u\u017e neexistuj\u00fa\u2026).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Na tej istej webovej str\u00e1nke n\u00e1jdete aj Protokol k dohovoru z roku 1978, ako aj zoznam jeho zmluvn\u00fdch str\u00e1n. Tento protokol sa t\u00fdka menov\u00fdch jednotiek pou\u017e\u00edvan\u00fdch pri v\u00fdpo\u010dte n\u00e1hrady \u0161kody.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u00daloha Dohovoru CMR<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Dohovor CMR je medzin\u00e1rodn\u00e1 dohoda, ktor\u00e1 upravuje pravidl\u00e1 cezhrani\u010dnej cestnej n\u00e1kladnej dopravy medzi krajinami, ktor\u00e9 k nemu prist\u00fapili.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Jeho hlavn\u00fdm cie\u013eom je stanovi\u0165 jednotn\u00e9 pravidl\u00e1 pre medzin\u00e1rodn\u00fa n\u00e1kladn\u00fa dopravu prostredn\u00edctvom definovania zodpovednosti a pr\u00e1v odosielate\u013ea, dopravcu a pr\u00edjemcu. Dohovor konkr\u00e9tne upravuje zodpovednos\u0165 dopravcu v pr\u00edpade straty, po\u0161kodenia alebo oneskorenia z\u00e1sielky po\u010das prepravy, ako aj postupy pri rie\u0161en\u00ed pr\u00edpadn\u00fdch sporov. Pr\u00e1ve preto predstavuje CMR jeden z najd\u00f4le\u017eitej\u0161\u00edch pr\u00e1vnych n\u00e1strojov v oblasti medzin\u00e1rodnej logistiky a cestnej dopravy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ak ste cestn\u00fd dopravca, je ve\u013emi pravdepodobn\u00e9, \u017ee ste sa vo svojej praxi stretli s ur\u010dit\u00fdmi praktick\u00fdmi ot\u00e1zkami t\u00fdkaj\u00facimi sa CMR. S cie\u013eom pom\u00f4c\u0165 vyrie\u0161i\u0165 naj\u010dastej\u0161ie nejasnosti v odvetv\u00ed zverejnila IRU na svojej webovej str\u00e1nke FAQ dokument obsahuj\u00faci naj\u010dastej\u0161ie ot\u00e1zky a odpovede. Napr\u00edklad: Je CMR n\u00e1kladn\u00fd list platn\u00fd, ak niektor\u00e9 polia nie s\u00fa vyplnen\u00e9? Spad\u00e1 cestn\u00e1 doprava medzi dvoma miestami v tej istej krajine pod ustanovenia Dohovoru CMR, ak trasa po\u010das celej prepravy vedie cez \u00fazemie in\u00e9ho \u0161t\u00e1tu (napr\u00edklad preprava medzi Ruskom a Kaliningradskou oblas\u0165ou)? Ako sa vypo\u010d\u00edtava n\u00e1hrada za tovar straten\u00fd dopravcom?<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">CMR n\u00e1kladn\u00fd list<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">K\u013e\u00fa\u010dov\u00fdm dokumentom v tomto syst\u00e9me je CMR n\u00e1kladn\u00fd list, teda medzin\u00e1rodn\u00fd cestn\u00fd n\u00e1kladn\u00fd list, ktor\u00fd sprev\u00e1dza tovar po\u010das prepravy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Ide o \u0161tandardizovan\u00fd formul\u00e1r s 24 poliami vytvoren\u00fd Medzin\u00e1rodnou \u00faniou cestnej dopravy (IRU), medzin\u00e1rodnou organiz\u00e1ciou zodpovednou za koordin\u00e1ciu a zastupovanie zdru\u017een\u00ed cestnej dopravy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Obsahuje v\u0161etky d\u00f4le\u017eit\u00e9 \u00fadaje o z\u00e1sielke \u2013 inform\u00e1cie o odosielate\u013eovi a pr\u00edjemcovi, popis a mno\u017estvo tovaru, miesto nakl\u00e1dky a vykl\u00e1dky, ako aj pr\u00edpadn\u00e9 osobitn\u00e9 podmienky prepravy. Tento dokument potvrdzuje uzatvorenie prepravnej zmluvy a prevzatie tovaru na prepravu, pri\u010dom z\u00e1rove\u0148 zohr\u00e1va v\u00fdznamn\u00fa \u00falohu pri coln\u00fdch konaniach, faktur\u00e1cii dopravn\u00fdch slu\u017eieb a pri pr\u00edpadn\u00fdch reklam\u00e1ci\u00e1ch alebo s\u00fadnych sporoch.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pre dopravcov je obzvl\u00e1\u0161\u0165 d\u00f4le\u017eit\u00e9 pri prevzat\u00ed tovaru z\u00e1sielku skontrolova\u0165 a porovna\u0165 stav n\u00e1kladu s \u00fadajmi uveden\u00fdmi v CMR n\u00e1kladnom liste. Ak existuj\u00fa ak\u00e9ko\u013evek nezrovnalosti alebo rozdiely, mali by by\u0165 do dokument\u00e1cie zap\u00edsan\u00e9 pr\u00edslu\u0161n\u00e9 pozn\u00e1mky, aby bola chr\u00e1nen\u00e1 pr\u00e1vna poz\u00edcia dopravcu a jasne definovan\u00e1 zodpovednos\u0165 v\u0161etk\u00fdch str\u00e1n zapojen\u00fdch do prepravn\u00e9ho procesu.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">CMR n\u00e1kladn\u00fd list sa zvy\u010dajne vystavuje v nieko\u013ek\u00fdch k\u00f3pi\u00e1ch r\u00f4znych farieb: jedna k\u00f3pia zost\u00e1va odosielate\u013eovi, jedna sprev\u00e1dza tovar k pr\u00edjemcovi a zvy\u0161n\u00e9 k\u00f3pie sl\u00fa\u017eia dopravcovi na administrat\u00edvne a prev\u00e1dzkov\u00e9 \u00fa\u010dely po\u010das prepravy.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">eCMR: Digitaliz\u00e1cia ako logick\u00fd \u010fal\u0161\u00ed krok<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Vo febru\u00e1ri 2008 bol prijat\u00fd nov\u00fd Protokol k Dohovoru CMR t\u00fdkaj\u00faci sa elektronick\u00e9ho n\u00e1kladn\u00e9ho listu (eCMR). Protokol nadobudol platnos\u0165 5. j\u00fana 2011 a do m\u00e1ja 2026 ho prijalo celkovo 41 kraj\u00edn. Najnov\u0161ou z nich je Severn\u00e9 Maced\u00f3nsko, ktor\u00e9 ho prijalo len nieko\u013eko t\u00fd\u017ed\u0148ov po Alb\u00e1nsku.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prechod z papierov\u00fdch n\u00e1kladn\u00fdch listov na elektronick\u00e9 prin\u00e1\u0161a mno\u017estvo v\u00fdhod.<\/p>\n\n\n\n<p class=\"wp-block-paragraph translation-block\">V prvom rade doch\u00e1dza k v\u00fdrazn\u00fdm \u00faspor\u00e1m n\u00e1kladov. Pod\u013ea \u00fadajov IRU zni\u017euje eCMR n\u00e1klady na spracovanie dokumentov troj- a\u017e \u0161tvorn\u00e1sobne, ur\u00fdch\u013euje faktur\u00e1ciu a administrat\u00edvne procesy v\u010faka men\u0161iemu mno\u017estvu manu\u00e1lneho zad\u00e1vania \u00fadajov a zni\u017euje nezrovnalosti pri doru\u010den\u00ed a prevzat\u00ed tovaru.\u201c<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Okrem toho prin\u00e1\u0161a vy\u0161\u0161iu transparentnos\u0165.
